http://www.redherring.com/insider/2000/0108/news-realnetworks.html?id=yahoo Online music distributors blast Realnetworks deal By Phil Harvey Redherring.com January 8, 2000 LAS VEGAS -- During his Consumer Electronics Show keynote address, Realnetworks (Nasdaq: RNWK) CEO Rob Glaser dropped a bomb on the online music business -- Realnetworks struck a deal with Universal Music Group, a move that creates more friction in an already fragmented market. The deal allows Realnetworks's Realjukebox -- the most popular online player for streaming and stored media -- to play Universal's large library of digital music. The deal will strengthen Realnetworks's position in the market and give Universal's music a potentially wide online audience. But Universal's insistence on using its own music distribution methods will strain online music-sellers, who'll need to ensure support for different distribution methods from different popular recording labels. CACOPHONY Liquid Audio (Nasdaq: LQID) and other digital distribution systems were vocal about their unhappiness with the Realnetworks/ Universal deal. Not only does it mean missed revenue for them, it keeps the recording industry's solutions fragmented, they say. "It will take a lot of work for each retailer to be able to honor a different distribution and copyright protection method from several different recording companies," says Andrea Fleming, vice president of corporate marketing at Liquid Audio. By not using the same solution as other recording labels, Universal runs the risk of alienating its online sellers, she claims. Though Realnetworks player will be able to play songs from Universal's library, Realnetworks is not the distribution mechanism for its music. Universal, whose properties include A&M Records and Geffen Records, says it will use its own digital audio format to distribute music to online retailers. Right now, record labels such as EMI Records Canada and Rykodisc use Liquid Audio's format to distribute their music. Still other artists make their songs available in the MP3 format, which offers no copyright protection for the music, much to the chagrin of recording labels. FINE-TUNING Universal's solution, still months away from being completed, will use Intertrust's (Nasdaq: ITRU) digital-rights management technology and Natwest Bank's Magex clearinghouse infrastructure. This process ensures that once music is purchased, it can't be copied and redistributed as allowed by open formats such as MP3, the company says. Universal's alliance with Realnetworks, though nonexclusive for both sides, is significant because it will allow consumers who buy the songs of Universal artists to enjoy the music outside the PC. Mr. Glaser announced that the latest version of Realjukebox would allow consumers to create and "burn" their own CDs, transfer songs to any of the portable storage devices made by Iomega (NYSE: IOM), and move music to Sony (NYSE: SNE) portable audio players such as the VAIO Music Clip and the Memory Stick Walkman. When consumers buy music at an online store, Universal will distribute the music to those stores, explains Albhy Galuten, a vice president of Universal Music Group. "The Realjukebox will empower the existing business of music distribution as an extension of what it's always done," he says. HARMONIZING Universal executives say they're preparing Universal's recording library for other digital media players, but they likely won't support Liquid Audio's player because it's part of a competing music distribution system. Still, refusal to be compatible isn't good for consumers, who don't want to have to keep different media players for different recording labels' content, Liquid Audio's Ms. Fleming says. "No one technology company is going to win, and it's important for each of the technology formats to interoperate," she says. Roadblocks abound on all sides for MP3 and open-source solutions in the online music business. "MP3 is not the whole shebang by any means," Mr. Glaser says, noting that Realjukebox will be able to show liner notes, song lyrics, and artwork for each song bought from Universal Music Group online. As for making Realnetworks's software an open-source solution, Mr. Glaser says, "I will guarantee you that the day Microsoft's [Nasdaq: MSFT] Windows becomes an open-source operating system, we'll make whatever components you want open source." |

Was ist daran besonderes? bisher redeten alle von Internet und MP3, einem offenen file-Format. Die Firma hier: MP3.com (und Liquid Audio). Diese Firmen und ihre Kurse erregten grosses Aufsehen, - was aber in der Euphorie oft uebersehen wurde/wird: die Kuenstler sind der breiten Masse der Konsumenten absolut unbekannt. Dies ist beim jetzigen deal zwischen Universal, Seagram und Realnetworks absolut anders! Diese haben die Grossen der Branche unter Vertrag! Und das "digital rights management" wird mit den Produkten von Intertrust gemacht! Prompt erinnerte CSFB an das 'strong buy' fuer ITRU. Und, aufgepasst, man rechnet hier bereits mit schwarzen Zahlen fuer 1999 und 2000! ITRU hat hier in einem extrem wichtigen Wachstumsmarkt des e-commerce Tritt gefasst. ITRU wird von einigen Analysten und Fondsmanagern unter den Top-Picks fuer 2000 genannt. Das Problem ist, dass kaum einer bisher versteht, was das fuer ein gewaltiger Markt ist (und die Analysten sehen hier fuer ITRU Margen wie sie sonst nur Microsoft hat). ich habe mir nochmals alles zu ITRU angeschaut, was ich habe. die Zahlen in der Meldung von CSFB koennen eigentlich nicht stimmen. soweit ich das sehe, duerften es in 1999 und 2000 noch keine Gewinne geben. Es waren bestimmt -0.92 und -0.89 $/share gemeint. Alles andere waere absolut sensationell, aber leider nicht sehr wahrscheinlich. |

As part of the deal, PricewaterhouseCoopers has made an equity investment of an undisclosed amount in the Santa Clara, Calif.-based company, the companies said in a statement. PricewaterhouseCoopers said it has also agreed to use InterTrust as the preferred digital rights management (DRM) provider for its clients and is licensed to sell InterTrust products, offer consulting services, and implement and manage the DRM software. Financial terms of the deal were not disclosed. InterTrust, one of the early players in DRM, gives content providers a way to block illegal copying with its flagship product, MetaTrust Utility. InterTrust competes against companies like Reciprocal, another DRM pioneer, and Canada-based RightMarkets.com. The DRM market has been gaining wider attention from investors in recent months. Yesterday, Reciprocal announced that key IBM executive John Schwartz has joined the company as chief executive. Last November, Reciprocal nabbed a $35 million round in financing from a broad investing group including Xerox and Hewlett-Packard.
